Terms of Service: The Rules of the Road

Welcome to Wayfinder Carts, a trade name of Wayfinder Cars B.V. Before we get moving, we need to agree on the route.

These Terms and Conditions (“Legal Terms”) constitute a binding agreement between You (the user/driver) and Wayfinder Cars B.V. (“Company,” “we,” “us,” or “our”). They govern your access to and use of our website (http://wayfinderdev.kinsta.cloud) and our related services.

The Short Version: By accessing our Services, you agree to follow these rules. If you do not agree with them, please park the car and discontinue the use of our Services immediately.

1. Who is in the Driver’s Seat?

Age Requirement: Just like driving a car requires a license, using our Services requires you to be at least 18 years old.

2. Intellectual Property (“Our Showroom”)

We have put a lot of work into building this engine.

  • Ownership: We own (or license) all source code, databases, designs, audio, video, text, and graphics on the Site (the “Content”), as well as the trademarks and logos (the “Marks”).

  • Your License: We grant you a limited, non-exclusive, revocable license to access the Site for your personal, non-commercial use.

  • Restrictions: You may not copy, reproduce, reverse-engineer, or resell any part of our “Showroom” without our express written permission. Think of it like a rental: enjoy the ride, but don’t strip the parts.

3. User Representations (“Your License to Drive”)

By using our Services, you promise that:

  1. All registration information you submit is true and accurate.

  2. You have the legal capacity to agree to these terms.

  3. You are not a minor (under 18).

  4. You will not use the Site for any illegal purposes.

  5. You are not a bot or an automated script.

If you provide false information, we reserve the right to suspend your account and revoke your access.

4. Traffic Violations (Prohibited Activities)

We want a safe journey for everyone. Therefore, the following “Traffic Violations” are strictly prohibited. You agree not to:

  • Vandalism: Attempting to bypass security, upload viruses, Trojan horses, or overload our servers (DDoS).

  • Road Rage: Harassing, annoying, intimidating, or threatening our employees or other users.

  • Unapproved Towing: Systematically retrieving data (scraping/mining) to create a collection or database without our permission.

  • Identity Theft: Impersonating another user or person.

  • Commercial Use: Using our Services to compete with us or for unauthorized revenue generation.

5. Your Contributions (“Passenger Feedback”)

While our Service doesn’t primarily function as a social platform, if you do send us feedback, ideas, or suggestions (“Submissions”):

  • Ownership: You agree that these Submissions become our property. We can use them to improve our engine without owing you compensation.

  • Responsibility: You are responsible for what you say. Do not submit content that is illegal, offensive, defamatory, or violates the rights of others.

6. Site Management & Termination (“Revoking the Keys”)

We reserve the right to manage the road to keep it safe. This includes:

  1. Monitoring for violations of these Terms.

  2. Taking legal action against violators.

  3. Termination: We may suspend or terminate your account or access at any time, without warning, if we believe you have violated these Terms or the law.

7. Modifications (“Road Work Ahead”)

We may update the content of the Services or these Legal Terms at any time. Just like road signs change, our policies might too. We will update the “Last Updated” date at the top. Your continued use of the Service after changes implies acceptance.

8. Disclaimer (“Road Conditions”)

Please read this carefully. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE BUILD OUR CARS TO BE RELIABLE, BUT WE CANNOT CONTROL THE WEATHER.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SITE WILL BE FREE OF BUGS, ERRORS, OR VIRUSES, OR THAT INFORMATION WILL ALWAYS BE ACCURATE. YOU USE THE SITE AT YOUR OWN RISK.

9. Limitation of Liability

WE (AND OUR DIRECTORS/EMPLOYEES) ARE NOT LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING FROM YOUR USE OF THE SERVICE. OUR LIABILITY WILL ALWAYS BE LIMITED TO THE AMOUNT YOU HAVE PAID US (IF ANY) IN THE LAST 6 MONTHS.

Note: Some laws do not allow these limitations. If those laws apply to you, these limitations might not apply.

10. Indemnification

If your actions cause a crash—legally speaking—you agree to cover the damages. You agree to defend and indemnify Wayfinder Carts B.V. against any claims or demands (including legal fees) made by third parties due to your breach of these Terms or your violation of any law.

11. Governing Law (“Home Base”)

These Terms are governed by the laws of The Netherlands. Any disputes will be resolved in the courts of Amsterdam, although if you are an EU consumer, you retain your rights under your local consumer protection laws.

12. Electronic Communications

By using the Service, you agree to receive electronic communications (emails, notices on the site) from us. You agree that these digital notices satisfy any legal requirement that such communications be “in writing.”
